01Agreement to these terms
These Terms and Conditions ("Terms") are a binding agreement between you and HTMT LLC, a Florida limited liability company doing business as PhotogU ("PhotogU," "we," "us," or "our"). They govern your access to and use of our websites, courses, mentorship program, communities, communications, and any other products or services we offer (together, the "Services").
By accessing the Services, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. Section 16 contains a binding arbitration agreement and a class-action waiver that affect how disputes are resolved. Please read it carefully.
02Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Services or make a purchase. The Services are not directed to and may not be used by anyone under 18.
When you create an account you agree to provide accurate information and to keep it current. You are responsible for all activity under your account and for keeping your login credentials confidential. Accounts and access are personal to you and may not be shared, transferred, or sold.
03What we provide
PhotogU offers educational and coaching products for wedding and event photographers, which may include digital courses, downloadable materials, templates, a group mentorship program with live calls, private communities, and free resources such as workbooks and guides.
Our products are educational and informational. They are not a substitute for your own professional, legal, financial, or business judgment. We may add, change, or discontinue any part of the Services at any time.
04Pricing, payment and plans
Prices are shown at checkout and may change at any time, though changes will not affect an order you have already placed. You are responsible for any applicable taxes. Payments are processed by our third-party payment processors, which may include Kajabi Payments, Stripe, and PayPal. By purchasing, you authorize us and our processors to charge your selected payment method for the amounts you agree to.
Payment plans and installments (mentorship)
The mentorship may be offered on a payment plan. If you choose a plan, you authorize us to automatically charge your payment method for each scheduled installment until the full amount is paid. By enrolling on a plan you agree that:
- You owe the full program price. A payment plan is a payment schedule for that full amount, not a discount or a per-month subscription you can cancel to reduce what you owe.
- If a payment fails or is late, we may retry the charge, pause or suspend your access until the balance is current, and, after notice, declare the entire remaining balance immediately due.
- You remain responsible for the full balance, and for reasonable costs of collection permitted by law, if you stop paying.
- You will keep your payment method valid and current for the duration of the plan.
05Refund policy
Courses and digital products
Individual courses, bundles, presets, and other digital products come with a 30-day, no-questions-asked refund. If you are not satisfied, email support@theweddinglegends.com within 30 days of purchase and we will refund your payment. After 30 days, these products are non-refundable.
Mentorship
The mentorship carries a 14-day refund window from the date of purchase. Because the program is built to get you moving and producing results, we ask for the chance to help before you leave. To request a mentorship refund, contact support@theweddinglegends.com within the 14-day window. You agree to a good-faith conversation with our team so we can understand your situation and offer support. If, after that conversation, you still wish to withdraw within the 14-day window and your account is in good standing (all payments current), we will issue a refund of amounts paid.
Mentorship refunds are not available: after the 14-day window has closed; where an account is past due; or where these Terms have been violated (including sharing or reselling program materials).
How refunds are paid
Approved refunds are returned to the original payment method within a reasonable time. Free resources have no purchase price and are not subject to refund.
06Chargebacks
If you believe you are owed a refund, use the refund process in Section 5 first. You agree not to initiate a chargeback, payment dispute, or reversal with your bank or card issuer for a charge you authorized. Initiating a chargeback in violation of these Terms is a breach of this agreement, may result in immediate and permanent termination of your access, and does not release you from amounts you owe. We reserve the right to dispute chargebacks with evidence of your agreement to these Terms and to recover related costs to the extent permitted by law.
07Intellectual property and license
All content in the Services, including videos, curriculum, templates, scripts, ad frameworks, workbooks, text, graphics, and the PhotogU name and marks, is owned by PhotogU or its licensors and is protected by intellectual property laws.
When you buy or access a product, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use that content for your own use only. You may not copy, record, download (except where a download is expressly provided), republish, share, resell, license, distribute, or create derivative works from the content, and you may not share your login or account access. We may revoke your license and access if you breach these Terms.
08Mentorship terms
The mentorship includes access to program materials and to scheduled live group calls for the duration of your enrollment. Call times are scheduled in advance and may be adjusted around the instructor's availability. Live sessions may be recorded and made available to members, and by participating you consent to being recorded.
You agree to conduct yourself professionally and respectfully in all calls, communities, and communications. We may remove you from any community or call, without refund beyond what Section 5 provides, for abusive, disruptive, or unlawful behavior, or for sharing other members' information or the program's materials.
Coaching and feedback are opinions and suggestions based on the instructor's experience. You are responsible for the decisions you make in your own business.
09Earnings and results disclaimer
We do not guarantee any particular income, booking volume, pricing, or business result. Any figures we share, including the instructor's own numbers (such as average booking values, monthly bookings, or advertising results), describe the instructor's individual experience and are examples, not promises of what you will earn.
Testimonials and case studies reflect individual experiences and are not typical or guaranteed. Your results depend on many factors we do not control, including your effort, skill, market, timing, and how you apply what you learn. Photography and business involve risk, and you may earn less, the same, or nothing. Statements about future outcomes are aspirational and are not guarantees.
10Acceptable use
You agree not to: use the Services for any unlawful purpose; infringe anyone's intellectual property or privacy; share, pirate, or resell our content or your access; harass or harm other members or staff; attempt to gain unauthorized access to our systems; scrape or copy the Services by automated means; or interfere with the operation or security of the Services. We may suspend or terminate access for any violation.
11Text messages and email
SMS/text messages. When you provide your phone number and opt in, you consent to receive recurring automated text messages from PhotogU, including appointment and call reminders, account and program updates, and marketing or promotional offers, at the number provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to unsubscribe and HELP for help. Carriers are not liable for delayed or undelivered messages.
Email. When you opt in or make a purchase, you may receive service emails and marketing emails from us. You can unsubscribe from marketing emails at any time using the link in any email. We may still send you transactional messages about your account or purchases.
12Third-party services
The Services rely on third-party platforms, including Kajabi (hosting and course delivery), GoHighLevel/LeadConnector (CRM, automation, and messaging), our payment processors, and analytics and advertising tools. Your use of those services may also be governed by their own terms. We are not responsible for third-party services, websites, or content that we link to or integrate with.
13Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any result will be achieved. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.
14Limitation of liability
To the fullest extent permitted by law, PhotogU and its owners, members, and staff will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, revenue, data, or goodwill, arising out of or related to the Services, even if advised of the possibility. To the fullest extent permitted by law, our total aggregate liability for any claim relating to the Services will not exceed the amount you paid to us for the product giving rise to the claim in the 12 months before the event. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
15Indemnification
You agree to indemnify and hold harmless PhotogU and its owners, members, and staff from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, your content, your violation of these Terms, or your violation of any law or the rights of a third party.
16Dispute resolution and binding arbitration
Please read this section carefully. It affects your legal rights.
Informal resolution first
Before starting any formal proceeding, you agree to first contact us at support@theweddinglegends.com and give us 30 days to resolve the matter informally. Most concerns can be handled this way.
Binding arbitration
If we cannot resolve a dispute informally, you and PhotogU agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration, administered by the American Arbitration Association under its applicable rules, rather than in court. The arbitration will take place in Miami-Dade County, Florida, or by remote means, and judgment on the award may be entered in any court with jurisdiction.
Class-action and jury-trial waiver
You and PhotogU agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. You and PhotogU each waive any right to a jury trial and any right to participate in a class action.
Exceptions
Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief to protect intellectual property. This section is governed by the Federal Arbitration Act.
17Termination
We may suspend or terminate your access to the Services at any time if you breach these Terms, fail to pay, initiate a prohibited chargeback, or misuse the Services. On termination, the license granted to you ends and you must stop using the content. Sections that by their nature should survive, including payment obligations, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, survive termination.
18Changes to these terms
We may update these Terms from time to time. When we do, we will update the effective date above and post the revised Terms here. Your continued use of the Services after changes take effect means you accept the revised Terms.
19General
These Terms and the Privacy Policy are the entire agreement between you and PhotogU regarding the Services. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules, and, except for matters subject to arbitration, the exclusive venue for any permitted court action is Miami-Dade County, Florida. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them, for example in a merger or sale of the business. We are not liable for delays or failures caused by events beyond our reasonable control.
